Safe Properties Defined

Safe Properties By-laws are designed to provide protection to the public with regard to health and safety issues. Safe Properties By-laws are authorized by the Planning Act and the Building Code. The individual by-law establishes the standards that must be adhered to in order to comply with the by-law.

The Safe Properties By-law establishes the standards for the maintenance and occupancy of property within the municipality. These standards are designed to prohibit the occupancy of buildings that do not conform to the established standards. 

How are safe properties enforced?

The enforcement procedure for a safe property issue begins with a written complaint from someone directly involved with the possible violation.

The By-law Enforcement Officer, or their designate then investigates the complaint by way of a site inspection. If a violation is noted a Notice of Violation is mailed to the property owner.

The Notice will provide information regarding the type of violation that has been observed and the necessary actions on the part of the property owner to bring the property into conformity with the property by-law.

If the violation is not remedied within the time frame indicated on the Notice of Violation then the By-law Enforcement Officer may issue an Order to Remedy.

An Order to Remedy requires the property owner to correct the violation and establishes a time frame within which the repairs must be completed. An Order to Remedy indicates to the property owner that if the violation is not corrected that the municipality may intervene and correct the problem at the expense of the owner.

Appeals of an Order can be made to the Safe Properties Committee of the Township of Elizabethtown-Kitley within 14 days of services of the Order or another time as specified. The Committee may confirm, modify or rescind an Order on appeal.
